Apply on the Startup India portal (startupindia.gov.in) with the entity's Certificate of Incorporation, a write-up on the innovation in the product/process/service, and details of funding (if any). DPIIT recognition is granted if the entity is up to 10 years from incorporation, has annual turnover not exceeding ₹100 crore, and works towards innovation, improvement of products/processes, or scalable business model with high employment. Tax exemption under Section 80-IAC requires a separate application.
No, MSME Udyam Registration under the MSME Development Act 2006 is voluntary. However, it is practically required for priority-sector lending rates from banks, the 45-day delayed-payment protection under Section 15 of the MSMED Act 2006, government tender eligibility (75% MSE procurement mandate), and subsidy schemes including Credit Linked Capital Subsidy Scheme (CLCSS) and Prime Minister's Employment Generation Programme (PMEGP).
IEC (Importer-Exporter Code) under the Foreign Trade Policy 2023 is issued by DGFT through the online portal (dgft.gov.in) on submission of PAN, Aadhaar, bank certificate and address proof. The IEC is auto-approved and is typically issued within 1-2 working days. There is no renewal; the IEC is permanent for the life of the entity.
Under Section 3 of the Real Estate (Regulation and Development) Act 2016, every real-estate promoter selling a project with land area exceeding 500 sq.m. or more than 8 apartments must register the project with the State RERA Authority before any advertisement or sale. Real-estate agents under Section 9 must also register with RERA. Exemptions exist for projects completed before 1 May 2017 (the Act's commencement).
Udyog Aadhaar Memorandum (UAM) was the earlier MSME registration mechanism introduced in September 2015 - a self-declaration-based one-page filing. From 1 July 2020, UAM was replaced by Udyam Registration under the MSME (Classification, Registration and Renewal) Notification dated 26 June 2020. Existing UAM holders had to migrate to Udyam by 31 March 2021. Udyam Registration is PAN-linked and Aadhaar-linked; turnover and investment are auto-fetched from Income-tax and GST returns.
