RoC Pune operates as a sub-office of RoC Mumbai (the principal Registrar of Companies for Maharashtra and Goa). RoC Pune handles company filings for Pune district; companies with their registered office elsewhere in Maharashtra file before RoC Mumbai. All filings are made through the MCA21 portal.
Pune-based applicants file trade mark applications before the Trade Marks Office, Mumbai (which has jurisdiction over Maharashtra, Gujarat, Madhya Pradesh, Goa, Karnataka and the Union Territories). Pune does not have its own Trade Marks Office. Filings are made electronically through the IPIndia portal.
A PMC trade licence is issued under Section 380 of the Maharashtra Municipal Corporations Act, 1949 (the unified Maharashtra municipal statute - the PMC was constituted in 1950 as the first municipal corporation in Maharashtra after Mumbai). Applications are filed online through the PMC citizen portal at punecorporation.gov.in. The licence is mandatory for any commercial establishment operating within PMC limits and must be renewed annually.
Under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017, establishments with fewer than 10 workers are exempt from registration. Establishments with 10 or more workers must file an online intimation on the lms.maharashtra.gov.in portal within 30 days of commencement of business. No registration fee is payable.
Commercial disputes valued above ₹3 lakh filed in Pune district are heard by the Commercial Court at Pune (constituted under the Commercial Courts Act, 2015). High-value commercial and IP suits and appeals from the Trade Marks Office (Mumbai) and Patent Office (Mumbai branch) lie before the Bombay High Court at its principal seat in Mumbai - the Bombay High Court does not have a bench at Pune.
