Yes. An Indian resident can incorporate a US LLC or C-Corporation as a sole member or shareholder. Under the RBI Liberalised Remittance Scheme (LRS), an individual resident can remit up to USD 250,000 per financial year for overseas investment. The US LLC formation is done through a registered agent in Delaware, Wyoming, or Nevada; an Employer Identification Number (EIN) is obtained from the IRS.

Yes. Under FEMA Notification 263 and the Foreign Exchange Management (Transfer or Issue of any Foreign Security) Regulations 2004, an Indian resident making an overseas direct investment must file Form ODI (overseas direct investment) with the Authorised Dealer Bank, and an Annual Performance Report (APR) by 31 December each year. The RBI has migrated these filings to the EDBI (Export Data Processing and Monitoring System) portal since 22 August 2022.
