Trademark Germany

Germany's Deutsches Patent- und Markenamt (DPMA) is the largest trademark registry in Europe by application volume. A German trademark registration provides protection across all 16 federal states and is essential for any Indian business with physical operations, distribution partnerships, or e-commerce presence in Germany — Europe's largest economy. Germany is a member of the Madrid Protocol, and the DPMA also accepts direct national filings. German trademark law provides strong protection against well-known marks and has robust provisions against unfair competition. Registration is valid for 10 years from the filing date and is renewable indefinitely. The examination process typically takes 4 to 8 months, and the opposition period is 3 months from publication.

Any individual, partnership firm, LLP, private limited company, or corporate entity—whether domestic or foreign—is eligible to apply for trademark registration in Germany. For foreign applicants (including Indian businesses), the application must be submitted through a registered local agent or attorney, or designated internationally under the Madrid Protocol. A pre-existing trademark in India is not mandatory for a direct national application, but is required if you are utilizing the Madrid Protocol route. The mark must be distinctive, non-descriptive, and not conflict with any pre-existing registered trademarks or pending applications in Germany.
