Trademark France

France's Institut National de la Propriété Industrielle (INPI) manages the national trademark system with efficient processing and reasonable fees. A French trademark is essential for Indian businesses targeting the French market, particularly in luxury goods, fashion, food and beverage, and technology sectors where French consumers place high value on brand authenticity. France is a first-to-file jurisdiction and a member of the Madrid Protocol. The INPI examines applications for absolute grounds only (relative grounds are handled through opposition proceedings). Registration provides 10 years of protection, renewable indefinitely. The opposition period is 2 months from publication. France also provides strong protection for well-known marks under the Paris Convention, which is particularly relevant for globally recognised Indian brands.

Any individual, partnership firm, LLP, private limited company, or corporate entity—whether domestic or foreign—is eligible to apply for trademark registration in France. For foreign applicants (including Indian businesses), the application must be submitted through a registered local agent or attorney, or designated internationally under the Madrid Protocol. A pre-existing trademark in India is not mandatory for a direct national application, but is required if you are utilizing the Madrid Protocol route. The mark must be distinctive, non-descriptive, and not conflict with any pre-existing registered trademarks or pending applications in France.
