How often must a trademark be renewed?

Every 10 years from the date of registration, under s.25 of the Trade Marks Act 1999. The renewal can be filed up to 6 months before the expiry date.

What is the government fee for renewal?

₹5,000 per mark per class (Rule 81 / First Schedule). Restoration (if filed after expiry) attracts an additional ₹3,000 per mark per class under Rule 83.

What happens if I miss the renewal deadline?

The mark is removed from the Register under s.25(3). You can restore it within 6-12 months after expiry by paying the additional ₹3,000 restoration fee. After 12 months, the mark is permanently lost.

What is the difference between renewal and restoration?

Renewal is filed before the expiry date (or within 6 months after, with surcharge). Restoration is filed 6-12 months after expiry - requires the additional ₹3,000 fee plus the standard renewal fee.

Can I renew a trademark in only some classes?

Yes - each class is renewed independently. If you no longer need a class, simply do not renew that class; the Register entry for that class lapses.

Do I need to submit evidence of use at renewal?

No - renewal under s.25 does not require evidence of use. Use is required only if a s.47 non-use removal is filed against the mark.

Will the Registrar send me a renewal notice?

The Registrar issues a notice of expiration under Rule 82, but it is best practice to track the date independently. I-Pro tracks renewal dates for its clients and sends reminders.

Can I renew a trademark that has been assigned?

Yes - renewal is filed by the current registered proprietor (assignee). If the assignment is not yet recorded, file TM-P first, then TM-R.
