The eligibility to execute a Trademark Assignment is straightforward but legally strict. The 'Assignor' (the party transferring the mark) must be the legally registered proprietor of the trademark, or the official applicant if the mark is still pending. They must possess a clear, unencumbered title to the IP. The 'Assignee' (the party receiving the mark) can be any legally recognized entity capable of holding property—including individuals, Private Limited Companies, LLPs, or foreign corporations. Crucially, a trademark can be assigned whether it is officially 'Registered' or currently 'Pending' examination.
