Design Renewal

A registered design in India is valid for an initial period of 10 years from the date of registration under the Designs Act, 2000. Before this period expires, the registered proprietor must file an application for the extension of the design registration for an additional term of 5 years. This extension is the only renewal available — after the total 15-year maximum protection period, the design enters the public domain and cannot be further extended. The renewal application (Form-3 under the Designs Rules, 2001) must be filed before the expiry of the initial 10-year term. The Designs Act does not provide a grace period for late filing in the same way that trademark law does. If the renewal deadline is missed and the design registration lapses, there is no restoration provision — the design right is lost permanently. This makes timely renewal critical. The renewal process is administrative rather than substantive — the Design Office does not re-examine the novelty or originality of the design. As long as the application is filed on time with the prescribed fee, the extension is granted as a matter of course.
