The assignment itself is valid between the parties by virtue of the written deed under s.19 - recording in the Register under Rule 73 / Form V is not strictly mandatory. However, **recording is strongly advisable** because it provides constructive notice to third parties and is prima facie evidence of the assignee's title under s.48.

What is the government fee for Form V?

₹200 per application, per the Second Schedule of the Copyright Rules 2013. Stamp duty on the deed is separate and varies by State.

What happens if the period of assignment is not specified in the deed?

Under s.19(5) of the Copyright Act 1957 (post-2012 amendment), the period is **deemed to be 5 years** from the date of assignment. After 5 years, the copyright reverts to the assignor.

What happens if the territory is not specified?

Under s.19(6), the territory is **deemed to extend to the whole of India** (only within India, not outside).

Is the royalty / consideration clause mandatory?

Yes - s.19(7), inserted by the 2012 amendment, requires the royalty or share of consideration to be specified. If not specified, the assignment is liable to be held invalid.

Can a future work be assigned?

Yes, but under s.18(2), no assignment of copyright in a future work extends beyond the period of assignment; under s.19(3), the assignment takes effect only if the work comes into existence within 1 year.

Can the assignee further assign to a third party?

Yes, unless the original deed restricts further assignment. The further assignment is recorded on a separate Form V; the assignor of the original deed must be notified.
