What is the difference between a logo and a device mark?

In Indian practice the terms are used interchangeably — a device mark is any non-word trademark element: logo, design, monogram, label, or composite. A logo is one type of device mark.

What format does the logo need to be in?

JPEG, maximum 8 cm × 8 cm, minimum 300 dpi. If colour is claimed as a distinctive feature, file in colour and describe the colours in the application; otherwise file in black-and-white for broader protection.

What is Vienna Classification?

An international system under the Vienna Agreement that categorises figurative elements of marks (categories 1–29). The Registry assigns Vienna codes to logos at examination for device-mark search purposes.

Does a logo registration cover the word inside it?

Only if filed as a composite mark with the word claimed. A pure device registration protects the graphic only, not the wordmark — file separately for full protection.

What if I update my logo after registration?

Substantial changes require a fresh TM-A. Minor alterations (e.g. disclaimer of exclusive right to a part) can be done via Form TM-28 under Rule 65 — but the core design must remain.

Can I claim colour as a distinctive feature?

Yes — file a colour logo and add a colour claim. This narrows protection to that specific colour combination; black-and-white filing gives broader protection across all colours.

What is the government fee for logo registration?

Same as TM-A — ₹4,500 per class (individual/startup/SME); ₹9,000 per class (others). No separate logo fee.

Can a logo that copies another's copyright be registered?

No. The Registry will object under s.11(2) (well-known mark) or refuse on public-policy grounds. A copyright assignment from the designer must accompany the application.
