International trademark protection from India is available through three statutory routes. The [Madrid Protocol](https://www.wipo.int/madrid/en/) (effective in India from 8 July 2013) allows an Indian trademark owner to file a single international application through IP India in one language (English), designating up to 130+ member jurisdictions, paying a single fee in Swiss Francs (basic fee CHF 653 + CHF 100 per designation + complementary/individual fees per designated country). The international registration is dependent on the Indian base application for 5 years (the "dependency period" under Article 6ter of the Madrid Protocol), after which it becomes independent. The [Paris Convention](https://www.wipo.int/treaties/en/ip/paris/) route (India is a member since 7 December 1998) permits claiming priority - i.e. filing in any member country within 6 months of the Indian filing and treating the Indian filing date as the priority date in that country. Direct-filing (without Madrid or Paris priority) is the third route, used for non-Madrid members (e.g. Taiwan, Bangladesh, Pakistan, South Africa). Under the Madrid Protocol (effective in India from 8 July 2013), an Indian trademark owner with a pending Indian application or a registered Indian trademark (the 'basic mark') files Form MM2(E) through IP India, designating up to 130+ member jurisdictions. WIPO issues an International Registration (IR) within 2-4 weeks, then forwards to each designated country's TM Office for examination under national law (12-18 months to allow/refuse). The IR is dependent on the basic mark for 5 years - if the basic mark is withdrawn, refused, or cancelled within 5 years, the IR also transforms back to national applications.
Yes. Three routes: (1) Madrid Protocol - designate the USA in Form MM2(E) filed through IP India (basic fee + USA complementary fee CHF 275); (2) Paris Convention priority - file directly with the USPTO within 6 months of the Indian filing, claiming priority; (3) Direct-filing with the USPTO through a US-licensed attorney (mandatory since 1 August 2019 - USPTO requires foreign-domiciled applicants to be represented by US counsel). USPTO application fee is USD 350 per class.
As of 2026, notable non-members of the Madrid Protocol include: Bangladesh, Pakistan, Taiwan, South Africa (joined Aug 2025 - pending entry into force), Saudi Arabia, Iran, Iraq, Argentina, Brazil (joined Oct 2025 - pending entry into force), Venezuela, most of Central Asia (Kazakhstan, Uzbekistan, Turkmenistan, Tajikistan, Kyrgyzstan). For these jurisdictions, direct national filing or regional filing (e.g. OAPI for Francophone Africa, ARIPO for Anglophone Africa) is required.
The Madrid Protocol fee is payable in Swiss Francs to WIPO: (i) Basic fee CHF 653 (CHF 903 for colour marks); (ii) Designation fee CHF 100 per country (or complementary/individual fee if the country has notified WIPO of higher fees); (iii) Additional class fee CHF 100 per additional class beyond the first. For a single-class mark designating 5 countries with no individual fees, total WIPO fee โ CHF 1,153 โ โน1,10,000. IP India transmits fee is โน2,000. Indian Agent's professional fee is additional.
Yes. The United Arab Emirates acceded to the Madrid Protocol on 28 September 2021, with the Protocol entering into force for the UAE on 28 December 2021. Indian applicants can now designate the UAE in a Madrid application (complementary fee CHF 1,006 per class). Prior to Madrid accession, direct-filing through the UAE Ministry of Economy was the only route.
