Six Variables That Decide Your Bill
There are six variables that decide what your final bill looks like.
a) WHO you are (applicant type). The Patent Office splits applicants into three fee buckets: "Natural Person / Startup" (₹1,600), "Small Entity" (₹4,000), and "Others" (₹8,000). Your legal structure and your DPIIT/MSME recognition status decides which bucket you fall into.
b) PROVISIONAL vs COMPLETE specification. This is the #1 cost variable. 3. Software patents have a Section 3(k) trap. India excludes "computer programs per se" from patentability. To get a software patent granted, the invention must demonstrate "technical effect" beyond the code itself. Many inventors waste ₹50,000+ in drafting fees only to be rejected.
