- Paragraph 1 - the statute: The Real Estate (Regulation and Development) Act 2016 (RERA) was enacted on 25 March 2016 and brought into force on 1 May 2016 (Section 2 and Sections 14-78 came into force on that date; the rest from 1 August 2016). The Act mandates the registration of every real-estate project (where the land area exceeds 500 square metres or the number of apartments exceeds 8) with the Real Estate Regulatory Authority of the state where the project is located - before any advertisement, booking, sale or allotment. Real-estate agents (intermediaries who facilitate the sale) must also register under s.9. The Act's stated purpose is to protect the interest of the allottee (the home buyer) - and the substantive provisions (s.18 refund-with-compensation for delayed possession, s.14 structural defect liability for 5 years, s.19 rights of the allottee including stage-wise disclosure) reflect that tilt.
