- Paragraph 1 - the labour law landscape (post-new-code position): Indian labour law is in transition. The four new labour Codes - the Code on Wages 2019, the Industrial Relations Code 2020, the Code on Social Security 2020, and the Occupational Safety, Health and Working Conditions Code 2020 - were enacted between 2019 and 2020 but, as of the date of this dossier, have not been brought into force (the Centre has notified some rules, but several states have not finalised state rules; the Codes require concurrent state rules to be operational). Until the Codes are notified, the legacy statutes - EPF Act 1952, ESI Act 1948, Payment of Gratuity Act 1972, Employees' State Insurance Act, Minimum Wages Act 1948, Payment of Bonus Act 1965, Factories Act 1948, Shops & Establishments Acts (state-specific), Maternity Benefit Act 1961, POSH Act 2013, BOCW Act 1996 - continue to apply. Part 6 covers the legacy regime that is currently in force, with a forward-section on what the Codes will change.
